When you receive a two-year conditional green card based on marriage, the next step is to remove the conditions before it expires. Filing Form I-751, Petition to Remove Conditions on Residence, is critical to maintaining your lawful permanent resident status.

What Is the Process?

  1. File Form I-751:

    • This form must be filed within the 90-day window before your green card’s expiration date.

  2. Provide Supporting Evidence:

    • Include proof of your ongoing marital relationship, such as joint financial documents, proof of shared residence, and other evidence demonstrating your bona fide marriage.

  3. Biometrics Appointment:

    • In most cases, USCIS will schedule you for a biometrics appointment to update your records.

  4. Receive Decision or Attend an Interview:

    • USCIS may approve your petition without an interview if your evidence is strong. If additional information is needed, you may be scheduled for an interview.

How Long Does It Take?

Processing times for Form I-751 can vary depending on the USCIS service center handling your case. As of now, it can take 12 to 24 months to process the petition. Fortunately, filing Form I-751 automatically extends your green card for 48 months beyond its expiration date, allowing you to continue living and working in the U.S. while your petition is pending.
