What is naturalization?
Citizenship and naturalization are crucial milestones in an immigrant's journey to becoming a full member of the United States. Naturalization is the process by which U.S. citizenship is granted to a foreign citizen or national after fulfilling the requirements established by Congress in the Immigration and Nationality Act (INA).
Eligibility Requirements
To be eligible for naturalization, applicants must meet several criteria:
- Age: Must be at least 18 years old at the time of filing
- Residency: Must have been a lawful permanent resident (green card holder) for at least five years, or three years if applying as a spouse of a U.S. citizen.
- Continuous Residence: Must have continuously resided in the U.S. for at least five years (or three years for spouses of U.S. citizens).
- Physical Presence: Must have been physically present in the U.S. for at least 30 months out of the five years preceding the application (or 18 months out of three years for spouses of U.S. citizens).
- Good Moral Character: Must demonstrate good moral character, generally assessed over the five-year period (or three years for spouses of U.S. citizens).
- English Language Proficiency: Must be able to read, write, and speak basic English.
- Civics Knowledge: Must have knowledge of U.S. government and history, demonstrated through a civics test.
- Attachment to the Constitution: Must be willing to take the Oath of Allegiance to the United States.
Application Process
- Prepare Form N-400: The applicant must complete and file Form N-400, along with the required filing fee and supporting documents.
- Biometrics Appointment: After filing, USCIS will schedule a biometrics appointment for the applicant to provide fingerprints, photographs, and a signature.
- Interview: USCIS will schedule an interview to review the application, test English language skills, and administer the civics test. Do you want us to attend your USCIS interview?
- Oath of Allegiance: If approved, the applicant will be scheduled for a naturalization ceremony where they will take the Oath of Allegiance, becoming a U.S. citizen.
Supporting Documentation
Applicants must provide various documents to support their naturalization application, including:
- Permanent Resident Card (Green Card)
- Photographs: Two passport-style photos
- Identification: Valid passport, state-issued ID, or other official identification
- Proof of Residence: Utility bills, lease agreements, or other documents showing physical presence and continuous residence
- Tax Returns: Copies of federal income tax returns
- Marriage & Divorce Documents: If applicable, proof of marital status changes
Civics & English Tests
During the naturalization interview, applicants must demonstrate an understanding of the English language and knowledge of U.S. civics. The civics test includes questions about U.S. history and government, while the English test assesses reading, writing, and speaking skills.
